Arrest without a warrant

The following guidelines provide information when arresting a suspect without a warrant.

Arresting a suspect (Arrest without a warrant)

  1. You must have reasonable and probable grounds to arrest a suspect.
  2. If reasonable and probable grounds exist:
    • arrest the suspect
    • specify the offence
    • advise of rights and caution
  3. Search the suspect incidental to arrest and collect:
    • weapons
    • evidence
    • tools of escape
  4. Handcuff if necessary.
  5. Record any words spoken by the suspect.
  6. Record the suspect's:
    • injuries and bloodstains
    • mental condition, behaviour, and sobriety
    • appearance
    • clothing and condition
  7. Treat the suspect as a young offender if under 18.

Handling a suspect (Arrest without a warrant)

  1. Never leave the suspect unattended.
  2. Isolate the suspect from other suspects and witnesses.
  3. Keep to a minimum the number of officers dealing with the suspect.
  4. Keep the suspect away from the crime scene once you remove him/her from it.
  5. Seek immediate medical aid if the suspect is injured.
  6. Consider a breathalyser test. The suspect must agree to it.
  7. Consider a gun-shot residue test.

  1. Collect the suspect's clothing if appropriate.
  2. Find the suspect replacement clothing.
  3. Respect the suspect's right to:
    • obtain legal counsel
    • remain silent
  4. Do not persist in questioning a suspect who has exercised these rights.
  5. Keep the suspect in sight if suicide is a concern.
