The following guidelines provide information when arresting
a suspect without a warrant.

(Arrest without a warrant)
- You must have
reasonable and probable grounds to arrest a suspect.
- If reasonable and probable grounds exist:
- arrest the suspect
- specify the offence
- advise of rights and caution
- Search the suspect incidental to arrest and collect:
- weapons
- evidence
- tools of escape
- Handcuff if necessary.
- Record any words spoken by the suspect.
- Record the suspect's:
- injuries and bloodstains
- mental condition, behaviour, and sobriety
- appearance
- clothing and condition
- Treat the suspect as a young offender if under
18.

- Never leave the suspect unattended.
- Isolate the suspect from other suspects and witnesses.
- Keep to a minimum the number of officers dealing
with the suspect.
- Keep the suspect away from the crime scene once
you remove him/her from it.
- Seek immediate medical aid if the suspect is injured.
- Consider a breathalyser test. The suspect must
agree to it.
- Consider a gun-shot residue test.

- obtain legal counsel
- remain silent
- Do not persist in questioning a suspect who has
